TERMS & CONDITIONS.
INTRODUCTION
These terms and conditions apply to all transactions or orders placed with Deft Design Studios (Pty) Ltd, whether online, through the website order page, via email, in person, or any other form. By placing an order with Deft Studios, you agree that these terms are binding on you without qualification or exception. You acknowledge having read, understood and accepted these terms. If you disagree with these terms, please refrain from placing an order. Deft Studios may periodically change the terms, without notice, so kindly check them from time to time as the users continued use of the site signifies acceptance of any changed terms.
PRODUCTS
Most product information can be found on product tear sheets, available online. For additional information on designs and products, please contact us at hello@deftstudios.co.za. All images represent colours and finishes as accurately as possible. Please note that variations can occur since every piece of timber is unique. Deft Studios reserves the right to change product descriptions and pricing without notice, and we may discontinue products at anytime.
NATURAL MATERIALS
Timber is a natural material. Variations occur in colour, textures and markings including knots and sapwood. All timber is carefully hand selected and each furniture piece will display its own unique characteristics. Deft Studios has done its best to display as accurately as possible, the colours and finishes of products shown on this website. Deft Studios cannot be held liable for slight colour variations from the website to actual product.
ORDERS
Furniture and/ or smaller items can be ordered directly from the website or by contacting us via email. Information and pricing for signature pieces are available on request only, please send an email to hello@deftstudios.co.za for inquiries. For custom designed pieces please reach out us with your requirements via email. We will provide you with specific design details for approval before processing the order.
PRODUCTION
Lead times vary based on the workload and the complexity of fabrication. Majority of furniture is made to order. We keep a limited amount of stock of certain pieces - if your order is urgent please inquire about stock availability. For specific product lead times please refer to product tear sheets on the website. Deft Studios will not be held liable for production delays caused by unforeseen circumstances or external factors which could not reasonably or practically be avoided in the ordinary conduct of business. This shall include, but is not limited to, acts of God, natural disasters, unplanned load shedding/ electrical outages, unforeseen material shortages or machinery failures which cause delays.
PAYMENTS
We accept card payments and EFTs. A 50% non-refundable deposit is required to secure your order for production. The outstanding amount will need to be settled before your order is shipped.
TRADE DISCOUNT
Deft Studios provide designer discount exclusively to industry professionals. Trade discount determinations are solely at our discretion. We reserve the right to allocate trade discount to orders depending on the size, project timeframe and complexity of the furniture, as well as the quantity of the order. Our discount cannot be exchanged for cash. Please reach out to us with your necessary information. We would love to work with you.
NATIONAL SHIPPING
Deft Studios uses third party courier services. Courier costs are not included in the retail price and will be calculated at checkout. Shipping costs are calculated based on product size, weight and destination. Orders will only be dispatched once full payment has been received. You will receive an email when your pieces are ready for dispatch, providing the tracking details for your parcel and necessary delivery information. Please allow 3 - 5 working working days for delivery. Outlying areas might require additional time. When placing your order please ensure that you provide the correct shipping address and contact details for a successful delivery.
INTERNATIONAL SHIPPING
Deft Studios uses third party courier services. Shipping costs are calculated based on product size, weight and destination. For international shipments please request a quotation by sending us your delivery address (hello@deftstudios.co.za). Deft Studios will not be liable for customs and import duties, these are at the buyer’s expense. Orders will only be dispatched once full payment has been received. You will receive an email when your pieces are ready for dispatch, providing the tracking details for your parcel and necessary delivery information. When placing your order please ensure that you provide the correct shipping address and contact details for a successful delivery. Deft Studios uses reputable courier services. We personally crate international orders with the utmost care and diligence, however Deft Studios will not be liable for loss or damages caused by third-party couriers.
THIRD PARTY COURIER SERVICES
Deft Studios uses third party courier services and do not offer personal delivery services. Please familiarise yourself with the courier service’s obligations since we have to adhere to their terms of operation.
DELIVERY
Deft Studios cannot schedule a specific day or time for delivery. You will receive an email when your pieces are ready for dispatch, providing the tracking details for your parcel and necessary delivery information. Hereafter, please be in contact with the couriers if you need any additional assistance or have any delivery queries. Third party courier services operate on their own delivery route and timeframe which depends on the region of delivery. Usually you can expect delivery between 2-5 working days.
COURIER OBLIGATIONS
Please take note that couriers provide third party services over which Deft Studios have no control. Couriers will not be liable for unwrapping, installing or moving large furniture around your premises. Please arrange with a friend, handyman or a third party service to assist you with moving heavy and large parcels.
DAMAGE & LIABILITY DURING DELIVERY
You are responsible for checking pieces upon delivery. If your order was damaged during transit - don’t panic. Please email us (hello@deftstudios.co.za) within 24 hours of delivery receipt. Please include photographs of the damages before completely removing or discarding the packaging and wrapping. If these instructions are not followed accordingly Deft Studios cannot assist you with repairs. Deft Studios will consult with the couriers, after which we will repair the furniture to the best of our abilities, at no additional cost, and if deemed necessary, we will replace the piece(s). Please ensure that pieces are securely wrapped before we schedule collection for return. Failure to follow will void liability.
RETURNS & EXCHANGES
Please choose carefully as Deft Studios does not refund or exchange furniture unless they are structurally faulty, in which case we will repair or replace your furniture as deemed necessary. Furniture is crafted to order, making pieces customisable to your specifications. We work on a booking basis and do not accept cancellations once an order has been confirmed.
CANCELLATIONS
By law, clients have a 5-day period after which a 50% deposit has been made, to cancel the order. When production has started on the piece(s) we won’t accept any cancellations and the deposit will be forfeited as a penalty, acknowledged by the client.
WARRANTY
Domestic use
Deft Studios provides a structural warranty for 5 years from the date of receipt/ delivery of furniture used in a domestic environment. This warranty covers the workmanship and structural integrity of the furniture. If furniture proves to be defective in these aspects we will repair the furniture. In the event where repair is not possible, we will replace your furniture.
This warranty excludes general wear and tear, misuse, accidents, damage obtained during moving furniture, damage due to improper installation or lack of care or negligence of furniture. The warranty shall expire with immediate effect when the customer attempts to repair, and/ or send the product for repair to any other person, and or service provider. Should the customer make any alterations or purchase any parts to self-repair the product, the warranty will also expire with immediate effect.
This warranty does not cover deterioration of finishes, cracking or joint separation due to unsuitable placement in locations subject to direct sunlight, moisture or fluctuating temperatures. A material care guide is always available on our website and will also be included with the furniture on delivery. Please familiarise yourself with these guidelines to ensure your furniture is long lived.
Commercial use
Warranty on products used in a commercial environment will vary from product to product. If a commercial warranty is required, please request information on the specific piece prior to purchasing goods. Please send us an email to hello@deftstudios.co.za for more information.
USE OF FURNITURE
Furniture is suitable for residential and commercial purposes. Please make sure to notify Deft Studios when furniture will be used within a commercial environment. We take extra precaution with the durability of finishes, and take additional measures to provide suitability for a more heavy traffic environment. While furniture is crafted with utmost care, skill and quality, the products aren’t specifically tested for commercial or public use.
Clients should make sure to familiarise themselves with the material care guide provided on our website. If the client transfers goods to a third party, they must inform the third party about the material care guide, as well as the terms & conditions. General maintenance on any piece of wooden furniture is unavoidable over time.
LIABILITY
Deft Studios will not accept any liability for any damage, however caused, whether directly or indirectly be suffered in connection with the product use. Deft will not be liable for loss suffered by any person, arising from the performance of Deft’s obligations due to any cause which Deft could not reasonably or practically avoid in the ordinary conduct of business. This shall include, but is not limited to, acts of God, natural disasters, electrical outages, unforeseen material shortages or machinery failures which cause delays.
COPYRIGHT NOTICE
All content seen on this website are subject to trademark, copyright and/or other intellectual property rights or licenses held by Deft Studios. Any use of materials on the site, including distribution, modification or reproduction, without the prior written consent of Deft Studios and the lawful trademark and/or copyright owner (if applicable) is strictly prohibited and constitutes an unlawful infringement of the intellectual property rights of Deft Studios and/or such trademark and/or copyright owner.
INTELLECTUAL PROPERTY
The Client acknowledges that all design, trademarks, copyright and intellectual property rights in the goods and the business name of Deft Studios vests solely in Deft, and no right of any kind in the Deft IP, including but not limited, the right of licence are granted to the client or any other party. The Client undertakes that he/she/ they/ it will in no way, whether directly or indirectly, in any capacity replicate, reproduce, or misuse any of the Deft Studios IP or permit any other person do to any of the preceding. We own intellectual property rights in our goods, and you may not use those rights without our permission. We will prosecute you for any violation of our proprietary rights.
LAW
All provisions of these Terms shall be governed by and construed by the laws of the Republic of South Africa. Furthermore, the parties to these terms now irrevocably and unconditionally consent to the non-exclusive jurisdiction of the Republic of South Africa courts regarding all matter arising from these Terms.
PRIVACY
As people, we are committed to privacy. When you purchase something from us, as part of the buying and selling process, we collect the personal information you give us such as your name, address, contact details and email address. In order to fulfil your order, we share this information with third party courier services in order to deliver your furniture to your home. These third parties couriers are also committed to maintaining the confidentiality and security of your information. Your data is safe and will not be shared or sold to any other third parties. All payment information is entered through an encrypted and secure line via YOCO. This security prevents our company and others from reading or retracting your data.
